Article 261(1) of the Electronic Communications Act requires prior consent for marketing email, but since 2021 the Act defines the protected "consumer" as a natural person acting outside their business. For companies, article 6 of the E-Commerce Act applies: you may email them unless their address is in the opt-out register kept by the Commission for Consumer Protection, and an unsolicited commercial email must be recognisable as unsolicited as soon as it arrives.
What you have to do
- Check every company address against the Commission for Consumer Protection's opt-out register before sending
- Make the email recognisable as an unsolicited commercial message as soon as it arrives
- Show who you are and give a valid address where the recipient can ask you to stop
- Private individuals acting as consumers need prior consent
