Section 7(2) of Act 480/2004 allows electronic contact details to be used for commercial communications only for users who gave prior consent. The Act defines a user as any natural or legal person, so companies are covered.
What you have to do
- Get consent before the first email
- Mark every message clearly as a commercial communication, do not hide the sender, and include a valid address for refusing further messages (section 7(4))
- Existing customers only: allowed for your own similar products or services if they can clearly refuse, free of charge, at collection and in every message (section 7(3))
