Under section 103-1 of the Electronic Communications Act, email marketing to a natural person needs prior consent. Marketing to a legal person is allowed if every message gives a clear, free and easy way to refuse, which can be used over an electronic network.
What you have to do
- Give a clear, free and easy way to refuse in every message, usable by email or another electronic channel
- Make it possible to identify who the message is sent for
- Stop once the recipient has refused
- Existing customers: allowed for your own similar products if they could refuse at collection and in every message
Whether a named employee's work address counts as the company or as a natural person was not checked. The English translation used is the 2019 consolidated version; later amendments were not checked.
