Section 9 of the Law on Information Society Services bans commercial email without prior free and explicit consent, but paragraph 6 limits that ban to natural persons. For every recipient, the sender must give a valid address for asking to stop and must respect refusals.
What you have to do
- Include a valid email address or number where the recipient can ask you to stop
- Respect every refusal
- Existing customers: allowed for your own similar products if they did not object and can refuse free of charge in every message
Whether a named employee's work address counts as the company or as a natural person was not checked. Section 8 of the same law sets further rules on how a commercial communication must be identified, not covered here.
