Is B2B cold email legal in Luxembourg?

For a named person at a company the answer is not verified yet. For a generic address such as info@: yes, without prior consent.

Named person at a company

Generic company address
info@company.lu
No consent needed
Sole trader or personal mailbox
jane@gmail.com
Consent first

Article 11 of the amended law of 30 May 2005 requires prior consent for marketing email, but paragraph 5 limits that requirement to subscribers who are natural persons. Writing to a company does not need consent. Every message must show who it is from and give a valid address for asking you to stop.

What you have to do

  • Do not disguise or conceal who the email is from
  • Give a valid address where the recipient can ask you to stop, also when emailing a company
  • Existing customers: allowed for your own similar products if they could object free of charge at collection and in every message

Paragraph 1 speaks of the subscriber or the user, and the law does not say whether a named employee at a company address counts as the company. I did not find regulator guidance on this, so that case is marked as not verified.
