Is B2B cold email legal in Poland?

No, not without prior consent when you write to a named person at a company. The same applies to generic addresses such as info@.

Article 398 of the Electronic Communications Law bans sending commercial information, including direct marketing, to a subscriber or end user without prior consent. The law defines an end user as any entity using the service, so companies are covered as well as individuals.

What you have to do

  • Get consent before the first email
  • Consent can be given by the recipient providing their address for the purpose of receiving commercial information at that address
  • Do not treat an address published for other purposes as consent

Breaking the ban is also an act of unfair competition under article 398(4). No UKE or UODO statement specifically on B2B email was found.
