Article 13-A of Law 41/2004 requires prior express consent of a subscriber who is a natural person, or of the user. That rule does not apply to subscribers that are legal persons: they may be emailed until they refuse and register on the national opt-out list kept by the consumer authority (DGC).
What you have to do
- Before emailing companies, check the DGC list of legal persons that object. Senders are obliged to consult it and it is updated monthly
- Do not hide who the message is from, and give a valid contact for asking you to stop (article 13-A(4))
- Existing customers: allowed for your own similar products if they can refuse easily and free of charge at collection and in every message
A named employee's address is left open: the consent rule also protects the "user", and whether that covers an employee using a company mailbox was not checked.
Text as added by Law 46/2012. Later amendments were not checked.
