Article 226 of the Electronic Communications Act (ZEKom-2) requires prior consent for marketing email, but paragraph 4 limits that to subscribers who are natural persons. Paragraph 6 allows email to a person's address when the company has published it as its own contact address. Every email must show who it is from and give a valid address for asking you to stop.
What you have to do
- Write to a named employee only if the company published that address as its contact address
- Do not hide or disguise who the email is from
- Give a valid address where the recipient can ask you to stop
- Existing customers: allowed for your own similar products if they could refuse free of charge at collection and in every message
